Software Disclaimer. THE LICENSED SOFTWARE IS PROVIDED "AS IS" AND, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, SOFTCURE MAKES NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, BY STATUTE OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. SOFTCURE DOES NOT WARRANT THAT THE SOFTWARE WILL FUNCTION UNINTERRUPTED, THAT IT WILL MEET EVERY REQUIREMENT OF THE CLIENT, THAT IT IS ERROR-FREE, OR THAT ANY ERRORS WILL BE CORRECTED.
1. The information, software, products, and services included in or available through the Softcure Software services may include inaccuracies or typographical errors. Changes are periodically made to the Softcure Software services and to the information therein. Softcure Software and/or its respective suppliers may make improvements and changes in the Softcure Software sites/services at any time. Advice received via the Softcure Software sites/services should not be relied upon for personal, legal, or financial decisions.
2. The company provides offline software for a hospital management system that is installed on the client’s personal computer, where the software can only be run within the premises of the hospital with client-server technology. The hospital should have proper intranet/networking & a fixed server IP with a LAN wire Cat-6 to run clients.
3. AMC - Annual Maintenance Contract: The company covers training, software updates, operating system compliance updates, speed boosting, and re-installation (if any Windows crash occurs at the server/main system).
4. The company provides support or maintenance within the AMC period only. If AMC expired, no support will be entertained.
5. The software company does not warrant the functions contained in the program will meet your requirements or that the operation of the program will be uninterrupted or error-free.
6. For offline software setup, no monitoring connection is with the company to handle the proper data execution while using the software.
7. Neither the company is responsible for any data loss nor for any data Genuity that feeds/data entered by the hospital billing staff/users.
8. The company never provides you the financial data/financial mis record of your hospital software with any medium for any of your purposes.
9. The financial data can be downloaded using the accounting module of the software with the user and password that were provided during the software installation at the server computer.
10. On the day of installation, the company registered the hospital in the software with a contact number & an email ID. For any support hospital can approach the company with only these registered emails & contact numbers.
11. No communication other than registered email will be treated as valid. The company is liable to respond or reply only with that registered email. All other email communication is not valid, and the company is not responsible/bound to answer for any such communication.
12. The company is not bound or answerable for any hospital financial loss/disputes/administration conflicts/trust/society/management disputes while using our software.
13. The company always recommends to the hospitals to cross-check their financial entries on a weekly basis. No query will be handled for deleting any entries from the software.
14. For offline software, the company can provide re-installation/server shifting only once in a year. Thereafter, each reinstallation is chargeable.
15. While installing the software, the configuration details provided by the hospital, like the LOGO & ADDRESS, will remain unchanged throughout the services/usage of the software.
16. All data that need to be uploaded in the software, like Rate Master, TPA Rate, Doctor List, Lab Masters, etc., should be emailed to the company in the Excel/CSV with a pre-defined column format only. Data upload formats can be accessed at this Link
17. MIS reports within the software have a Date Range Limit for page optimization. The client's request for exceeding the limit may cause page slowness/drowsiness.
18. No responsibility is for the financial loss/disputes that occur on the client’s side or for any hospital administration’s conflict or legal case.
19. All legal disputes are subject to the jurisdiction of the District courts (District of the software company only).
20. Support for Legal Answers can be taken through legal@softcure.in only.
Software’s Data Backup Responsibility for Offline Installations
Softcure HMS is also offering offline software that is installed on the facility's premises’ computer with no online connectivity with us.
In this concern, it is for all your kind information that we (Softcure) do not keep any of your data backup with us, whereas we provide the data back wizard along with the software that keeps regular backups on a daily basis at your computer where the Softcure software is installed.
We also offer AMC/CMC, which covers maintenance & uptime support, but that service also does not cover the data backup activities at our end.
Hence, it is a very important recommendation for the hospital’s concerned authority to keep that software’s data backup in some reliable external drive so that the system can be recovered in case of any crash/mishandling/major hardware fault.
